Preamble
These Terms of Service (hereinafter referred to as 'Terms') define the conditions for using the service (hereinafter referred to as 'Service') provided by AId band (hereinafter referred to as 'Company') on this website. All registered users (hereinafter referred to as 'Users') shall use the Service in accordance with these Terms.
Article 1 (Application)
1. These Terms apply to all relationships between Users and the Company regarding the use of the Service.
2. The Company may establish rules and other provisions (hereinafter referred to as 'Individual Provisions') regarding the Service in addition to these Terms. Regardless of their name, these Individual Provisions shall constitute part of these Terms.
3. If provisions of these Terms conflict with provisions of the Individual Provisions mentioned in the preceding paragraph, the provisions of the Individual Provisions shall prevail unless otherwise specified in the Individual Provisions.
Article 2 (User Registration)
1. In this Service, registration is completed when a prospective user agrees to these Terms, applies for registration according to the method specified by the Company, and the Company approves the application.
2. The Company may not approve a registration application if it determines that the applicant falls under any of the following circumstances, and the Company shall not be obligated to disclose the reason:
• When false information is provided in the registration application
• When the application is from someone who has previously violated these Terms
• When the Company determines that registration is inappropriate for other reasons
Article 3 (Account Management)
1. Users shall properly manage their user ID and password for this Service at their own responsibility.
2. Users may not transfer, lend, or share their user ID and password with third parties under any circumstances. When login is performed with a combination of user ID and password that matches the registered information, the Company shall consider it as use by the User who registered that user ID.
3. The Company shall not be liable for any damages caused by the use of user ID and password by third parties, except when the Company has intent or gross negligence.
Article 4 (Usage Fees and Payment Methods)
1. Users shall pay the usage fees separately determined by the Company and displayed on this website for the paid portions of this Service, using the method specified by the Company.
2. If a User delays payment of usage fees, the User shall pay late payment damages at an annual rate of 14.6%.
Article 5 (Prohibited Acts)
Users shall not engage in the following actions when using the Service:
1. Actions that violate laws or public order and morals
2. Actions related to criminal activities
3. Actions that infringe on copyrights, trademarks, or other intellectual property rights included in the Service
4. Actions that destroy or interfere with the functions of servers or networks of the Company, other Users, or third parties
5. Actions that use information obtained through the Service for commercial purposes
6. Actions that may interfere with the operation of the Company's services
7. Actions of unauthorized access or attempts thereof
8. Actions of collecting or accumulating personal information about other Users
9. Actions of using this Service for fraudulent purposes
10. Actions that cause disadvantage, damage, or discomfort to other Users or third parties
11. Actions of impersonating other Users
12. Advertising, promotion, solicitation, or business activities on this Service without the Company's permission
13. Actions aimed at meeting unknown persons of the opposite sex
14. Actions that directly or indirectly provide benefits to antisocial forces in connection with the Company's services
15. Other actions that the Company deems inappropriate
Article 6 (Voice Data Handling)
1. Voice data used by users in this Service is used only for real-time processing and is not stored on servers.
2. Voice data is immediately discarded after processing is completed.
3. The Company does not provide voice data to third parties or use it for AI training.
4. Users are deemed to understand and agree to the processing of voice data.
5. If technical problems occur during voice data processing, the Company will respond as quickly as possible, but does not guarantee data integrity.
Article 7 (Suspension of Service Provision)
1. The Company may suspend or interrupt all or part of the Service without prior notice to Users if any of the following circumstances occur:
• When performing maintenance, inspection, or updates of computer systems related to this Service
• When provision of this Service becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters
• When computers or communication lines stop due to accidents
• When the Company determines that provision of this Service is difficult for other reasons
2. The Company shall not be liable for any disadvantages or damages suffered by Users or third parties due to suspension or interruption of Service provision.
Article 8 (Usage Restrictions and Registration Deletion)
1. The Company may restrict all or part of a User's use of this Service or delete the User's registration without prior notice if the User falls under any of the following:
• When violating any provision of these Terms
• When false information in registration details is discovered
• When there is non-performance of payment obligations such as fees
• When there is no response to communications from the Company for a certain period
• When there is no use of this Service for a certain period from the last use
• When the Company determines that use of this Service is inappropriate for other reasons
2. The Company shall not be liable for any damages caused to Users by actions taken by the Company based on this Article.
Article 9 (Withdrawal)
Users may withdraw from this Service through withdrawal procedures specified by the Company.
Article 10 (Disclaimer and Limitation of Liability)
1. The Company does not guarantee, either explicitly or implicitly, that this Service is free from factual or legal defects (including defects, errors, bugs, rights infringement, etc. related to safety, reliability, accuracy, completeness, effectiveness, fitness for specific purposes, security, etc.).
2. The Company shall not be liable for any damages caused to Users arising from this Service.
3. Notwithstanding the provisions of the preceding paragraph, this shall not apply to damages caused by the Company's intent or gross negligence. However, if the contract between the Company and Users regarding this Service (including these Terms) constitutes a consumer contract as defined in the Consumer Contract Act, this disclaimer provision shall not apply.
4. The Company shall not be liable for any transactions, communications, or disputes that occur between Users and other Users or third parties regarding this Service.
Article 11 (Changes to Service Content)
The Company may change the content of this Service or discontinue provision of this Service without notifying Users, and shall not be liable for any damages caused to Users thereby.
Article 12 (Changes to Terms of Service)
The Company may change these Terms at any time without notifying Users when deemed necessary. If a User begins using this Service after changes to these Terms, that User shall be deemed to have agreed to the changed Terms.
Article 13 (Handling of Personal Information)
The Company shall appropriately handle personal information obtained through the use of this Service in accordance with the Company's 'Privacy Policy'.
Article 14 (Notification or Communication)
Notifications or communications between Users and the Company shall be conducted by methods specified by the Company. Unless Users provide change notifications according to methods separately specified by the Company, the Company shall consider currently registered contact information as valid and send notifications or communications to such contact information, which shall be deemed to have reached Users at the time of transmission.
Article 15 (Prohibition of Assignment of Rights and Obligations)
Users may not assign their position under the usage contract or rights or obligations based on these Terms to third parties, or use them as collateral, without prior written consent from the Company.
Article 16 (Governing Law and Jurisdiction)
1. Japanese law shall be the governing law for the interpretation of these Terms.
2. In case of disputes regarding this Service, the court having jurisdiction over the location of the Company's head office shall have exclusive agreed jurisdiction.
